1. Introduction and Agreement

Welcome to Almighty1 Music. By using our services, you agree to comply with and be bound by these Terms & Conditions (“Terms”). These Terms govern your relationship with Almighty1 Music (referred to as “we,” “us,” or “our”) concerning the services described herein, including music distribution, transparent accounting, and artist support.

2. Services Provided

Almighty1 Music operates as a forward-thinking record label offering comprehensive services, including:

  • Global Music Distribution: Delivery of your musical content (“Content”) to our network of distribution partners, including, but not limited to, over 40 streaming and download platforms in over 240 countries worldwide. This includes platforms such as those facilitated by 7digital (e.g., Barry’s, Canva, Spotify, Apple Music, etc.).
  • Algorithmic Optimisation: Utilizing our distribution partner’s (Label Caster) deals with streaming sites to help trigger algorithms and increase the likelihood of Content being considered for editorial playlists (e.g., Spotify Editorial Playlists).
  • Transparent Accounting: Provision of a dedicated account accessible via a mobile app or web application, allowing artists to view streaming and sales data in real-time or near-real-time.

3. Artist Obligations and Content Rights

  • Content Rights: By submitting Content to Almighty1 Music, you represent and warrant that you are the sole and exclusive owner of all rights, titles, and interests in the Content, or have secured all necessary licenses, permissions, and clearances required for us to exploit the Content under these Terms.
  • Licence Grant: You grant Almighty1 Music a non-exclusive, worldwide, transferable license to distribute, reproduce, publicly perform, and otherwise exploit the Content in all media now known or hereafter devised, for the term and territory outlined in your specific Artist Agreement.
  • Indemnification: You agree to indemnify and hold harmless Almighty1 Music against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from any breach of your representations or warranties concerning your Content.

4. Revenue and Accounting

  • Revenue Share: The specific percentage split of net revenue derived from the exploitation of the Content will be outlined in your individual Artist Agreement.
  • Monthly Payments: Revenue due to the artist will be processed and paid monthly directly into your provided account.
  • Data Access: The transparent accounting system provides full access to streaming and sales data via the mobile or web application. We strive for accuracy but cannot guarantee the real-time accuracy of third-party data; all figures are subject to final confirmation from distribution partners.

5. Termination

The term of this agreement and the conditions for termination (including early termination and post-termination rights) will be governed by your Artist Agreement. Almighty1 Music reserves the right to suspend or terminate services immediately if you breach any part of these Terms or the Artist Agreement.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [INSERT GOVERNING JURISDICTION, e.g., The State of California] without regard to its conflict of law principles.
